Just one last thing. I notice that they will extend the deadline If you ask for a written statement of reasons. Is that the same letter as the ESA85a or doesn't that work as I didn't have a medical?

Hi JM,

The written statement of reasons is an ESA65.

An ESA85a is a medical report.

Oh rats! :(

When I rang the DWP ages ago I asked for both a statement of reasons as well as the other, but only received the ESA85a.

I suppose I've run out of time to ask for one considering the appeal form has to be in on Friday?

You don't need the SoR to lodge an appeal, the important thing is to get the appeal lodged with the DWP.

If you're hoping/trying to get the Decision overturned at a Reconsideration, make it clear that you will be submitting further evidence and testimony in the short term, once you have received the reports.

Hi JM.

If you have made a definate decision that you wish to appeal, I would print off, and fill in the GL24.

Don't forget you only need to print off the last few relevant pages, a lot of the form is advisory information.

Just give brief details of why you feel the decision was wrong, and say that you will provide more detail ASAP.

You could even seek representation from the CAB or other advice agency after submitting the GL24.

You can chase the other documents up, once your appeal is lodged.

If the appeal form has to be in by Friday 23/09/11, it may be necesssary to post it by guaranteed next day delivery, first thing in the morning.(keep a copy)

You will then have proof of delivery, and that you posted it back in good time.

Thing is I don't know what new evidence I could give. I explained all in my ESA form and included a very good letter from both my consultant from the chronic pain clinic and my GP saying that my condition is very difficult to treat etc. Not helped by the fact that due to other issues I cannot take any meds at all without making my pain worse. My advisor from WRAG said I should appeal. but I said I was too scared to rock the boat.

I'm coming to the conclusion that I may just leave it and try and deal with the work focused interviews somehow.

If my condition deteriates due to all this, well then I'll just have to cross that bridge when I come to It I suppose.
