Hi, if you appealed should the 'bundle' include an ESA113 form if your doctor had filled one out?

Hi Rachel

If an ESA113 has been issued there's no reason why it shouldn't be in the "bundle".

Hi Michael, can I be cheeky and put this another way?!

As there was not an ESA 113 in my appeals bundle, does that mean my doctor wasn't asked to fill one out?

Hi Rachel

I have searched and it appears doctors are not always asked to complete an ESA113. There's evidence (not sure how reliable) that Tribunals have questioned why not and requested one.

This is not my specialist area, so I will leave this open to a mod familiar with ESA113 to answer.

Thankyou Michael, I appreciate your replies.

I was wondering because CD mentioned 'burden of proof' in another post.

Obviously that is not for a first application of ESA but I have a reassessment coming up.

I will be very interested to see if my GP is contacted this time as there is no evidence to suggest that they were last time.

I think you really need an answer from a mod who has knowledge of ESA, this very complicated (to me at least) benefit!
