I am a member of the above and would appreciate if you could give me some advice relating to my case.

I am in receipt of ESA contribution based (WRAG) since December 2009 and had to fill in ESA 50 on 03rd of June 2011.I failed my medical on 5th of July 2011( scored 0 out of 15 points) and thus my ESA stopped on 21tst July 2011.

Following advice from your website I appealed on 15th August 2011 (within time permitted) and now I am in receipt of £67.50 (ESA assessment rate) back dated from 22nd July while the appeal is heard

I have read it somewhere or heard it on national news that currently they have a backlog of 15 months for all the appeals to heard , so would you advise me to contact them to give me my appeal date and in the mean time if they would restore my full ESA allowance of £94.25 pending my appeal

PS: I am also in receipt of DLA since 23/09/2009 (Mobility @ higher rate and Care component @ Lower rate

Sadly, your full rate will not be restored unless the DWP reviews its decision and grants you ESA.

There is no reason why you should not ask for a date for your appeal, although I think it unlikely that you will be told so soon.
