Have you escalated this situation to the Customer Services Manager at your local DWP office?

Is your appeal is still pending, as it would be normal for the DWP to lapse this is a Reconsideration finds in your favour?

yes gordon, my appeal is still pending despite me being told otherwise, the person who rang me was so rude, wouldnt give me his name when i asked and said to me "you wouldnt be in this mess if you passed the medical in the first place would you"... like its an exam..

ive written a letter of complaint to the jobcentre, but that was before this rude phone call.. i am awaiting a reply, its been 13 days so far...

With regard to your appeal, my best advice is for you to review our Appeals guide and the Claim guides in the Members Only area.

Apeals are won by showing that you meet the ESA criteria, so it is important that you detail how this is the case, and where possible, support this with evindence from your GP and other health care professionals.

i had a visit on tuesday from a company that is helping me with rehabilitation after my accident, they are arranging for someone to come to my home and do my gardening and house work for me on a few occasions a week to lift the load on my lovely wife. they said long term they wanna try and help me move to one level accomodation because it kills my knees getting up the stairs... i will have a report from her detailing all of this, do you think it would hold any weight with my appeal?

Hi,

Yes, you can use the report, hopefully it may help demonstrate/reinforce the relevant ESA descriptors (these are in the ESA guides in the members area)to help increase the number of points you may score.

ive been doing a bit of reading since i joined and done some digging on the HCP that did my medical,

and the guide says..

"All Health Care Professionals undertaking medical assessments must be registered medical practitioners, nursing practitioners or physiotherapists who, in addition, have undergone training in disability assessment medicine and specific training in the relevant benefit areas"

the HCP who did mine has no relevent qualifications according to the seach on the NMC website....

Hi,

The MNC website possibly isn't infallible. For example the HCP maybe newly qualified, or as in a friends sister in law's case, she is a registered Physio. However as there are two people with the same name where she works, to avoid confusion she actually practices under her maiden name.

However to verify, it maybe worth writing to ATOS healthcare to request details of the HCP that dealt with you, including (if a nurse or midwife) their relevant qualification from the NMC. If a Physio the Chartered Society of Physiotherapists, or if a Medical Prasctitioner (Doctor) the GMC.

Obviously it would be preferable if this is done in writing, or e-mail:

thanks, i really do think i'll win my appeal, the report is as usual riddled with inconsistancies....

i was awarded 9 points for manual dexterity... yet she says i can wash my own hair, and bath myself, yet i cant do up a button on my trousers...
