reconsideration or appeal ?? was created by tresco
Hi all
Am new to the forum. A few months ago I applied for disability living allowance and guess what, I was turned down! So I contacted C.A.B. for advice. That said I should not go to appeal first but to go for a reconsideration. Can anyone help please? Also when I asked for the form the C.A.B. adviser said she had never heard of it. ;)

We normally advise members to proceed with an appeal, as the decision will be automatically reconsidered by higher grade DM on receipt of the official appeal form GL24.

The DWP are intending at some time to introduce a more robust reconsideration process (whatever that means), but until such a change is implemented, is is advisable to submit an appeal straightaway using form GL24.

If the CAB adviser has never heard of form GL24, she must be very new to the job as this form would probably be the most familiar form used for adverse benefit decisions in the CAB office!

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi T, and welcome.

As a starting point have a look at the extensive DLA guides, which also covers appeals, from this link. :

www.benefitsandwork.co.uk/help-for-claimants

I am not absolutely clear what form you refer to, however to make an appeal, you should use a GL24 form, which can be downloaded and printed off from this link. :

www.dwp.gov.uk/docs/gl24dwp.pdf

Have a read of the GL24 before printing, as most of it is only advisory information.

You only actually need to print off the latter part of the form.

You must lodge your appeal within a month of receiving your adverse decision.

Once you lodge your appeal, you will automatically receive a reconsideration, which can take up to 12 weeks, at this stage the adverse decision may be changed in your favour, if not it will be sent forward to the appeals process.

Once you have looked at the guides if you have any queries of a general nature, please return to the forum.

If you only wish to ask for a reconsideration I would advise that you make this request in writing ASAP, if after reconsideration the decision is not changed, you can then appeal, if that's how you wish to go about it.
