Unfortunately everybody claiming incapacity or disabled benefits is going to have to get used to being re-asessed on a regular basis.

Obviously, you need to complete the ESA50 in order to retain your award, however, the onus is now on the DWP to prove that you no longer meet the requirements.

If you have evidence that supports your prognosis and treatment requirement then you should include this, you can also include the Tribunal Decision as evidence.

Please review the ESA guides as the criteria were updated at the end of March, and whilst I don't believe either of the criteria you qualified on were changed, there may have been a change of words that might affect you.

many thanks everyone, im going to ring them tomorrow and also ring my MP. Exceptional circumstances obviously dont mean the same to esa as it does to us
