Hi,

I recently had an ESA migration medical, was placed in WRAG and have just recieved the ESA85 (but not an ESA65 yet for some reason).

Despite having moderate/severe ME, following your guides and submitting 20 pages of addtional information I have been awarded no points for physical problems, and a completely inaccurate reflection on mental/cognitive ones. TBH it lkks like the docto that sawme decided I was entitled to WRAG and simply allocated points at random.

As I consider I should be in the support group on several grounds I will obviously be appealing.

My question is, given I've been awarded no points for physical/mobility issues, awareness of common hazards, learning problems etc. is there any point in applying for DLA when it's likely all they will do (as they've done before) is look at this report and bin my claim.

If I have to wait until after I win an ESA appeal thats a lot of money I would be losing that I consider I am entitled to (that I consider I have been entitled to for the last decade but have never had the resources to follow through an appeal on).

Is there any point putting myself through this again or should i just wait another year until after my appeal?

Hi Wonko

I understand from your post you are appealing your ESA and would like to claim DLA.

These benefits are seperate and one should not affect the other. You can find out more about DLA by reading the B&W guides.

I definately don't think the DLA unit will bin your claim, although in the future DLA is changing to Personal Independent Payments.

We have heard of a few cases where in deciding whether or not to award DLA, claimant's ESA has been referred to, but no hard evidence to date.

Good luck with you appeal and if you claim DLA.

I'm suprised you think that, as I have had prior claims turned down in days citing IB medical reports as the reason why.

So your saying this no longer happens?

Hi

AS we have no access to your previous claims. I am unable to speculate on your comment, only to general information that other members have given.

However, I can only repeat that you may be entitled to ESA & DLA, as they are regarded as seperate stand alone benefits.

If having read the B&W guides you feel you may qualify, there is information in the guides on how to successfully complete a DLA form.

As Moderators we are only able to give general advice about the B&W guides. It is not intended as substitute for face to face advice from an experienced Welfare Rights Officer.

I dont have it for ESA but I do for have hard evidence for IB reports being used for DLA which I would happily copy and send to you.

I referred to ESA and DLA, not IB and DLA, from reports made by some members. In particular a member's ESA report was used at DLA Tribunal by a panel Doctor.
