I'm really hoping someone can help me with this. At present i am waiting for a oral hearing for the appeal of my DLA & ESA, over the past few months i have been sending the tribunal services as much evidence i can but one very important piece of imformation that will hold alot of weight i'm getting trouble getting hold of?

I ask my neurologist consultant to give me written evidence with regards to my complex chronic migraines and he said he would be happy to do this with the correct forms? As it is now with the tribunal services i can not obtain the forms he was speaking about.

I saw my consultant today and ask him again explaining that now my case has gone to the tribunal services i was unable to get the DWP form for him, i told me without a written request from the courts he was unable to send them my medical records as it would be breach of patient confidentiality. Any ideas, i really feel that my consultants information will make a huge difference to my appeal??

Hi, you could ask the GP surgery for a copy of all the letters to and from the consultant?

Hi MC,

You can make a Data Protection Request at the hospital for all medical files that they hold on you, which will include any x-rays, diagnostic tests etc that your consultant may have done.

You can also arrange to view them as well, and maybe make copies of relevant data.

There will be a charge for the above.

Contact PALS who will be based at the hospital they can advise and help you with this.

You could also ask your consultant to provide you with supportive evidence, although he is not obliged to and may charge you for this service.

You can make a request that your consultant copies you in on any letters to your G.P., post out-patients appointments. This is free of charge, and does not entail any form filling, again PALS could help regarding this.

If you can gain your own evidence as above, you could then put it in front of the Tribunal, time permitting.

Thank you very much for your replies, it has been a great help. I'll get on to my GP straight away, i have a very supportive GP and i'm sure there will be no hesitation in him giving me copies of letters from the consultant?
