dla refused yet again

just had a letter that my dla application as been refused based on my claim form and health care doctor who examined me for esa i just feel like giving up now is there any point in appealing i dont think i could go through that tribunal again i have osteoarthritis,fybromyalgia,cfs,depression,

Sorry to hear your DLA claim was turned down. Did the decision specifically refer to it being based on your ESA examination? I'm interested in hearing about DLA claims failing due to ESA, as they are regarded as seperate benefits.
You can appeal within one month on form GL24. A different Decision Maker will look at it again, (reconsideration) if not changed will be listed for appeal. You can withdraw your appeal at any time. You should contact DLA unit Blackpool and ask for a Statement of Reasons, if you haven't had one.
You refer to several health conditions. Conditions are not enough to qualify for DLA, it is the needs that arise from them. eg if you need help due to your FM with say, bathing, you need to say, for example, I need help getting undressed, getting into the bath, someone to wash my hair, wash me down, help me out of the bath, dry me off and so on.

thanks for your advice michael the letter does state that their decision was made on my claim form and the health care professional who examined me me for esa on 17/05/2011 that dr wasnt even interested in my fybromyalgia symptoms ie chronic pain & fatigue
Hi Wissey
Thanks for letting me know that your claim for DLA was based on your ESA. We are hearing of this more and more, although to many of us it doesn't seem right.
The ESA examination was presumably based on LIMA software, which has come in for some criticism since introduction.
Whilst I cannot comment on your specific claim, you may stand a better chance of getting DLA, if you put all your medical conditions down and the help you need coping with them, whether you get that help or not is inmaterial.
