DWP won't accept old 'sick note'.

Any ideas folks?? Please??

ELA stopped in September after failed tribunal.

I re-applied, have been awarded it again.

Now, this is where the fun begins...........:-

I had a sick/fit note that was for the 'old' claim, for which I was receiving assessment rate ESA.

This sick note is valid until November 4th.

DWP say I need a new one from the date that the new claim started....September 22nd.

Local GP surgery are saying I can't have a new one as "the dates overlap".

What do I do? Apart from scream in frustration? :blink:

I can't find anything in the legislation or Decision Makers Guide that requires a new Fit note to be used for a new claim for ESA.

I would contact the DWP again and ask them to refer you to the relevant legislation or regulations that require this, on the basis that your doctor will not write a new Fit Note without such a requirement being identified.

Hi SNH,

This is a hard one to provide a definitive answer to.
You may well need face to face advice from the CAB or other advice agency, who will be able to look at all your personal details.

However, if your fresh claim for ESA is due to a deterioration in your conditions, or new conditions, the following extract may apply. :


If the appeal is unsuccessful, you should only issue further statements if their condition worsens significantly or they have a new medical condition.

It may help if you get a letter from the DWP stating that they need a new Med Cert (Fit Note), and why they need it, to cover you for the period in question.

I fear you will have to pursuade your G.P. of this, as he seems to be saying that as far as he is concerned, you are covered up until Nov 4th.

I am sorry that I cannot be of more help.

Maybe another Mod or member could enlighten you further.

It may also be a good idea to talk to the practice manager, rather than your GP.

If you explain your situation, I'm sure they would be understanding.

Thanks guys.

Yes, my condition has worsened slightly. I'll try again with the surgery tomorrow. It was the receptionist that told me that they wouldn't issue me another sicknote. Bl**dy woman!

When I reclaimed, by telephone, I was told that the sick note they were holding would be OK. On telephoning DWP this morning to ask why I'd received no money, this was when I was told I needed another sick note.

Credit cards are being stretched, as I've had no money since 14th Sep :blush:

Wish me luck. It's hard enough to live off £67 weekly as it is.

Hi SNH,

May I suggest that you make an appointment to see your G.P., to discuss your deterioration,and the issue of the Med Cert.

You can then be sure, that he is not willing to issue a Med Cert, rather than taking the word of a receptionist or anybody else.
