what to do about missed deadline was created by paula
Hi guys,
A question about missed deadline for the esa50, a friend of mine has been in hospital for a week, and she has been really ill where she did not open her post for three weeks. Her form has to get to atos no later than 27.10.11. she is getting the local cmht to phone them to ask for an extension to complete the form, I thought you had to put in a letter with the form is that correct. Also she is confused about supporting evdience and who it is supposed to go to. It says atos does not want evidence to go to them, but the letter she got with the esa50 did not say who is should go to. Our local medical place is croydon, but the envelope to send the qu estionnaire back is wembley. She has also been told by the team that the consultant will not provide a letter unless she has to go to appeal. What if they ask for more information the consultant will have to them won't they? Any advice about missed deadlines would be helpful. She is in a real state about this, and she only come out of hospital on Friday. Thanks guys :)

Hi,

although we cannot provide case specific advice, in general one needs to have a good reason for the late submission of the ESA50 if one does not wish to lose benefit.

Putting in a covering letter explaining the circumstances of being in hospital may suffice, however it is at the discretion of the DWP. They may need something formal from the hospital. Would the ward sister type something up to say the patient was in hospital between the relevant dates for example if the consultant will not play ball?

Re sending evidence, the ESA50 normally gets sent to Atos Medical Services. There is no loss in sending any extra evidence to them, but also copy it to the DWP office dealing with the claim (full name and national insurance No on every sheet).

Hi Paula

It's a good idea to phone them to advise that the form will be late with reasons so they have it on record, as well as explaining the missed deadline in a cover letter.

But the form needs to be sent as soon as possible. I would be weary of trusting any extended deadline your friend is given over the phone unless it's confirmed in writing.
