IB to ESA Migration was created by ritz
Hi everyone,

I have had the phonecall and am now awaiting the dreaded forms. My question is, if I am put into the work related group, not the support one, what happens if they try to force me into work after the 12 months and I am unwell again? Does the whole process start again and if I have already received ESA for 12 months and my husband earns over £16k will I not be eligible for any further benefits?

Thankyou!

No one can be forced to work while receiving ESA, however, if you are in the ESA WRAG for more than 365 days in total, then your eligibility for ESA(CB) will cease.

After this time you will be eligible for Income Realated ESA, however, based on your husbands income, I think it unlikely that you will receive any payments.

Hi RD,

With respect to filling in your ESA50 when it arrives, it would help to look at all the ESA Guides, in the orange MEMBERS ONLY area on the left.

Further with the help of the guides you could even start filling the ESA50 in now.

You can download and save the PDf version to your P.C. hard drive from this link. :

www.direct.gov.uk/prod_consum_dg/groups/...lasset/dg_195544.pdf

Many members find this Pdf much easier to complete, as you can save and edit as you wish, and then print it off and return it to ATOS by the deadline date that you will be given when you receive the ESA50 through the post.

It is pefectly acceptable to use the Pdf version rather than the hard copy that you will receive.

The good thing is that once you have printed off the Pdf version, you are left with an exact copy on your P.C. for future reference.

With regards to the 365 days time limit of Contributory WRAG ESA, see info here. :

www.benefitsandwork.co.uk/forum?func=vie...id=10&id=70444#70460

And here. :

www.benefitsandwork.co.uk/forum?func=vie...id=10&id=70450#70455

A claimant in the WRAG can not be forced to apply for, or take up employment.

Hope this helps

Hi,

Generally somewhere in the region of four to six weeks or so to get it returned.
