At the risk of being really annoying, for which I am really sorry but Gordon (or anyone else)

could you clarify the WFI FAQ that you do not have to attend a WFI if found 'fit' for work and are appealing the decision?

Many thanks as always.

Happy to, this is the section in question.

If you are appealing because you failed the ESA medical and were found Fit for Work, then you are not required to attend WFIs while you wait for your Tribunal to be heard.

Can you explain where it needs more detail :)

Thankyou Gordon, it doesn't need more detail! I am just an anxious so and so!

Could you just remind me where the statement comes from?

You are doing a fantastic job by the way! Very much appreciated :)

Best wishes,
Rachel

Hi LT,

The following applies if a claimant has not been awarded ESA at all, and has been assessed as "Fit for work". :

"If you are appealing because you failed the ESA medical and were found Fit for Work, then you are not required to attend WFIs while you wait for your Tribunal to be heard".

If a claimant has been put in to the WRAG of ESA, and is appealing that the he/she should actually be placed in the support group, then whilst appealing the claimant can still be compelled to take part in WFI's, but will not be sent forward to "The Works Programme" .

Hope this clarifies.
