Money will be paid pending appeal was created by The Thing
The current policy is that where an ESA recipient who is found fit for work following a work capability assessment (WCA) subsequently appeals against the decision, they will receive the assessment phase rate of ESA during the appeals process. Therefore, the amount of money the person receives will not change.

Those ESA claimants who appeal the WCA outcome of being placed in the Work Related Activity Group will continue to receive basic-rate ESA plus the work-related activity component until the outcome of the appeal is known.

But Grayling neatly sidestepped the question, which was not asking the current position...but if he had thought through the consequences of his proposal...it is patronising, deceitful and disingenuous for him to reply thus. Still at least one MP oppossess this....

Grayling made sure that he didn't comment on any future plans to remove the ESA Assessment rate while awaiting appeal, crafty 'person', and in so doing didn't answer the question put to him. However, at least Andrew Smith is more alert to the possible future removal of said support, and it's noted in the records.

QUESTION..

When appeal letter has been sent/accepted and they start paying the assesment rate again - Will this be backdated to the date they stopped the original payments after "failing atos medical with 0 points" ?


Hi RJ,

As long as your G.P. Med Cert covers you for the period from which you were found "fit for work", then you should receive assessment rate ESA from that date, even if it at a later date.

This is why it is important to submit your GL24 appeals form ASAP, and gain your Med Cert from your G.P. and forward a copy to the DWP.
