Hello everyone, this is my first post. I am about to appeal decision to be in WRAG instead of support group for ESA, I am housebound or bedbound due to ME/cfs and fibromyalgia most of the time. I will use your guides for appealing. The problem is that the HCP has stated incorrect information on their report, perhaps they misheard me three times?! Should I write my reasons for appealing and then mention these 'errors' and contadictions. One of the errors doesn't apply to ESA descriptors but goes against information that I wrote on DLA claim form. My DLA is up for renewal in two years. Any suggestions would be greatly appreciated.

Hi,

Although we cannot answer individual case queries, in general you are entitled to submit evidence which you believe rebuts whatever is on the medical report form. Even if that is just explaining that the report is incorrect and why.

It maybe helpful to obtain some face to face advice from a Welfare Rights Agency/CAB etc who can go through your claim paperwork in depth and advise you of the best approach in your individual case.

Do however be aware that there is a risk, albeit usually small but none the less possible, that what you have already been awarded (ie WRAG status) maybe overturned at either the reconsideration or Tribunal stage and you be found fit for work. Hence obtaining face to face advice is imperative both to ensure the relative safety of your current award and the prospects for getting placed into the Support Group.

Funny enough I am appealing mine now, I also have ME/CFS and I'm sure there didn't read my form, as one of the descriptors does apply to me and we put it I the form to them.
