Ill Health Retirement when in ESA (Support Group)

Folks, Some advice please.
Background. 1 am 53 year old male. I am in receipt of DLA (High Mob and Middle Carers), 50% War Disability Pension and have just received letter stating that I have gone straight into the ESA (support group)(1st attempt!). I have been off long term sick from work (mod civil servant) for 14 months (various chronic physical and mental health illnesses). The MOD Occ Health folks (Capita) say I can go back to work (after some rehabilitation) and have turned me down for an Ill Health Retirement for which I have now appealed. Because ATOS have said I am formally knackered (long term) can my bosses (MOD/Capita) still try and get me jump thru more of their hoops/medicals. I can't understand why they won't just listen to what ATOS has to say re my ill health!

Hi,

Unfortunately Occupational Pensions is not something we deal with on the forum albeit I do empathise with your situation. Unfortunately it is upto Capita which evidence they use to determine entitlement to a Pension and they are not bound to accept evidence from outside organisations such as Atos etc.

One line of approach maybe to take your case to The Pensions Ombudsman who deal with complaints about Pension Schemes but I believe you must have fully exhausted the relevant Pension Scheme Complaints Procedure first.

Well done for not giving up.....
I think you will probably have to take them to a Tribunal. Atos and Capita have been doing lots of stuff for other Government Departments including the DWP. ATOS has just recently lost some DWP contracts for health assessments and capita have retained them. Is this indicative of your situation; ATOS supports you retiring and Capita is holding the employer line? Who knows! You may have to consider a case against them either through any union to which you belong, or legally.
