Hi,

Can anyone advise if at reassessment one can be sent for a medical, as my husband was put into WRAG without a medical(which was of great relief) and i have asked for a written statement of this decission as i would like the decission to be reassesd!!!

Furthermore, i also would like to know if while we are appealing does my husband have to attend any work focused interviews?? Can i ask for them to be deferred until the reassessment results???

I'm not sure whether your husband could be called in for a medical at re-assessment, it can certainly happen if he decides to appeal.

I belive that your husband can be required to attend WFIs whilst the re-assessment/appeal is ongoing.

Thanks. In his form clear reasopns have been given as to the problems he has due to TWO severe head injuries in the mental descriptors, his frustration and anger cannot be managed and i am really worried of what will happen at the WFI.

When one wants to appeal and have verbally informed the DM dept and have asked for written statements,does the 4 week deadline still apply whilst you are waiting for ESA65/ESA85A????

Hi Radhika, yes the 4 week deadline does still apply.

However, appeals take an average of 26 weeks to be heard. This gives you plenty of time to send extra evidence to the Tribunal.

Hi,

No.

If one is asking for the forms with the intention of either asking for a reconsideration or appeal, such requests must be made in writing, either on a GL24 (if you think our decision is wrong) form, or by letter clearly stating your intentions - ie requesting a reconsideration or an appeal.

Just asking for the forms in isolation does not guarantee the deadline is extended, particularly if it is only done over the phone.
