And now, time for another ESA50 was created by cmarie510
Hello,

I have just received my second ESA50. I was put in the WRAG and I am currently waiting for a Tribunal date.

I will review the ESA guide for the ESA50 form, but is there another guide for those who are not applying for the first time?

Any things to DO or to NOT DO?

i may be wrong but i dont think you have to fill that out if you have appealed & are waiting on tribunal

Hi,

Sadly with ESA appeals averaging eight months from GL24 submission to Tribunal day (correct as at Aug 11 but maybe longer by now) it is not unusual for one's claim to be reviewed before the original appeal has been heard. However make it clear on the form you do have an appeal pending.

There is no separate guide for subsequent claims as all that applies to new claimants in reality applies to those applying again.

However there is nothing to stop you using any evidence gathered in the course of the first claim/tribunal submission provided it is still relevant and helpful to your case.

Hi Martin,

I thought that was the case until very recently, but however it is not 100% clear at the moment due to another case ongoing, hence pending clarifying it, advising to submit the new ESA50.

so i was wrong then? you may be required to fill in a new ESA50 while awaiting tribunal? so shocked at this merry go round used by DWP, the money it must be costing, i thought the point was to save money?! i think its tactics for us all to abandon our claims as its so exhausting especially for myself who is not always able to cope with my day due to mental health issues & me/cfs never mind constantly fill in forms.

can i ask, if nothing has changed since the last ESA50 & you've saved it online, is it acceptable to print off & send the exact same form as before, allbe it with the new date?

Hi,

Providing it is still relevant then yes, however there is a newer form (October 2011) in use but applications on the older form are acceptable.

However, more importantly, if that previous ESA50 led to a 'found fit for Work' or incorrect WRAG result, it maybe wiser to amend the new ESA50 to ensure ones case is fully stated. Else there is a risk of ending up with the same result yet again (however nothing is guaranteed in the ESA lottery and it is still possible the end result maybe the same).

It is very important to stress though that an appeal is currently pending when the 'new' claim is submitted.
