If you are on ESA(CB) and reach your 365day limit, you would be able to claim ESA(IR) if you qualified, taking into account your income, your capital and the number of hours worked by your partner. ESA(IR) would not be time limited (under the current proposals).

So ESAcb support group has no time limit, but if say I was entitled to ESAir on top of ESAcb because I fit the means test - would that mean in that instance the ir portion would also not be time limited.

You can remove this bit if you like Survivor - your reply was straight ir or cb, not the combination of both which was what I was trying to get at.

ESA(CB) will be time-limited to 365 days, but time spent in the support group will not count towards those 365 days.

If you reach your 365 day limit, you could claim the whole amount of ESA(IR), not just the top-up amount. ESA(IR) will not be time-limited under the proposed legislation.

On the assumption that the legislation is passed unchanged.

Time spent in the Support Group does not count towards the 365 days you are allowed to be in receipt of ESA(CB).

There is no time limit associated with ESA(IR), whether you are in the WRAG or the Support Group, however, there is an associated means test.

- have got head round it now. I do fit the means test but will have to find some motivation to apply for IR bit - just another hurdle.
