i have just had a so called medical at home this week and he said before he left that in his opinion i had this this & that which agreed with what i put on my forms, so i just wondered whether this meant i will carry on getting DLA or whether they just say it to your face and put in something different to DWP

Hi Sue

Agreeing with you sounds positive, however the doctor's report is merely done to help the Decision Maker decide your claim.

The fact that you have a Medical Or Mental Health condition does not necessarily mean you will qualify for DLA, its the help you need from another person, whether you get that help or not.

thank you for replying, i shall let you know how i get on. This is 1st medical and 4th form i have had to fill in 5 years for getting my DLA. I had a letter from my MP who sent me this letter from DWP that i think it was 100,000+ have never been checked at all since DLA started in the 1990's. So i will be writing to him when i know if i have got it again or not and see what he says, but i do not hold out much hope of anything positive.
I shall await the post and let you know.

You don't have to give up. If turned down you can ask for the decision to be looked at again, which will be done by a different DM. If not changed you can go to appeal, where an Independant Tribunal will decide.

You should always include as much supportive evidence as possible, from GP, consultant, health professional, even a friend.

I hope you will use the B&W guides, as they are written to give claimants the best possible help in completing the lenghty and repetitive DLA forms, or help with appeals.
