Hi i am new and very confused in july i went for a medical and in October was informed i got 0 points. I suffer severe depression and anxiety attacks what options are there open to me because my last payment will be on the 7th november what benefit will i be eligible for as i do not think i am capable of working today i have asked my GP to write a letter outlining all my mental health issues does this help ?

Hi Jayney, since finding this site has been a real eye opener to me as until Oct 2010 I was always working, and now reading what thousands of people are going through, not lest myself, angers intensly. Does you local council have a dedicated Benefits Advisory team? Or maybe try the CAB? There are people out there that can help you, just need to find ..... Good luck ... Eddie

As you have stated from your post that you are not capable of work, the only option is to appeal the adverse ESA decision.

Furthermore, if you feel if there has been a significant deterioration in your mental health since the date of the decision or indeed before this date, you may submit a further claim to ESA in addition to submitting an appeal? If not, and you do not have any new medical condition, you will have to wait until 26 weeks have elapsed from the date of the decision until you can reclaim ESA.

You are entitled to be paid at the ESA assessment rate pending the outcome of an appeal if you wish to take this course of action, but highlight the fact you wish to be paid ESA if and when you submit form GL24.

I have appealed against my ATOS medical im led to believe i will get a rate of benefit to cover me while the appeal is being decided how much is this and how do i claim it ?

On the assumption that you are appealing an ESA Decision that you are Fit for Work, then you are entitled to the ESA Assessment rate while you wait for your hearing.

The payment should be automatic, but you can confirm that you want to be paid this on either the GL24 Appeal Form or by letter to your local DWP office.

There are more details of the Appeal process in the ESA Appeals guide.
