Hi All,

It may have more impact if members made their request not to be contacted by phone, in the form of a seperate written request for this "Reasonable Adjustment" under Equalities Act 2010.

This request could be on a seperate letter accompanying, or included within the ESA50.

cheers

I have a slightly different reason for not always being able to use a phone, due to the problems with Cervical Spondylosis, I can't always pick up a phone or hold it to my ear. Could I claim reasonable adjustment for that as a request for written contact?

Hi P,

Any limitations suffered in using the phone due to any particular condition/disability could be used as a reason for the RA EA2010 request.

If nothing else, they may think twice before ignoring such a request.

If they do ring you can simply ignore the call, as the whole WCA process can be done without any phone contact whatsoever.

Thank you kindly, bro.
I've been worrying about that. There are times, and it's happening increasingly, when I can't physically answer a phone and have to sit there and listen to it ring, then when my carer comes round ask her to check who was phoning, if they'd left a message or if there was a return number to call.
Many thanks, Pen.

Hi Bro 58, thank you for what you have said, can you just go into the equality act 2010 post you have said. In regards to the whole wca process not being done by phone, atos send a letter telling you to phone them to arrange an appointment. Is the way to get around that to get someone to call them on the claimaint''s behalf?
There is the space at the last page of the questionnaire where someone else can be contacted on regards to a medical that atos can phone them instead and give reasons why that is the case. What a pilaver!
