Hi,
I have Angina which I take medication for I also use a spray.I explained that walking causes me discomfort and that the chest pain causes me to stop and use my spray.I also have severe Asthma among other conditions.
It seems most people, thanks to the media, now assume everyone who claims benefit is a fraud.My concern is if I am seen walking around the shopping centre.I did not say I could not walk but explained how walking affects me.
Am I worrying needlessly?

Hi A,

The only comment that I could make with respect to your concerns is that, any limitations suffered by a claimant should be for the "majority" of the time, unless the claimant has stated that these limitations fluctuate, and has explained how they fluctuate.

Further, for a claimant to be deemed able to carry out any actions with respect to the different descriptors, the claimant must be able to carry out said actions "repeatedly" "reliably" and "safely", with "reasonable regularity".

Yes. Many claimants who are paid DLA HRM can walk short distances.

The tests are distance walked without severe discomfort, speed and manner of walking and time taken to walk x distance. currently according to Upper Tribunal Decisions, around 60 metres, but in law there is no maximum distance. All factors have to be considered.
