hi i know i seem to be a pain but i would like any help available in telling me what the incapacity tribunal is looking for when dealing with a claim please so i can search the relevant paperwork and know what to put together. any help from anyone who has been to a tribunal who can tell me what kind of questions they ask and how they target the appellant would be much appreciated :)

Is this appeal for Employment and Support Allowance,ESA as I note that you say IB in your post?

sorry it is a medical for incapacity benefit that i failed and have a tribunal hearing next month

My reply appears to have disappeared during the thread merge so I repeat it below.

At any tribunal hearing, the appellant must have all the same case bundle as the tribunal panel, if not that amounts to a ' breach of natural justice', which in layman's terms means 'fair play at work'.

That is why the Tribunal Judge had no option but to adjourn your appeal.

You will be provided with a copy of the IB50, and the Tribunals Service will send you a new date ASAP.

what do you mean hun plz?

i also need to know can the chair look over the mental side too even if i have no gp letter as i have been told im mildly depressed but because i have no supporting evidence from the time of the medical that they wont take it into account

With regards to the documents that you should have had at the Tribunal Hearing, you should have been sent a "bundle" of documents by the DWP decision maker, when your appeal was sent forward to the Appeals Tribunal Service.
