Big Gross Error in ESA was created by Dorset-angel
I have been to court once with my ESA and i moved over a year ago. DWP were informed along with DLA. 6 Months ago i went for another medical - to be told i had to appeal of which i did and as i have not heard anything i decided to chase this up due to my ME Support worker on holiday for the next 4 weeks!! I had a letter today asking for another medical certificate of which i decided i was going to get to the route of this as before long i will be at the same stage again in the next few months of another fresh claim. I have been on £65.00 a week for the last 6 months. Anyway on telephoning today and been passed to pillar to post - i had to ring the tribunal Services only to find out of which was clarified to me that they struck it out as all my correspondance has been going to my old address of which i have not lived there for 2 year. DWP did not inform tribunal of my new address and i now have to start my claim from scratch !! of which i feel ill over this matter today. I am thinking of seeking a solicitor over this matter as i feel and even the tribunal people have admitted DWP were in gross error!!

Please help and advise ASAP

You may well have a case for gross maladministration on the part of the DWP.

I will be taking this matter further as they struck it out of Court on August on 2011 as the papers went to the old address. But yet they still send me a letter for medical certificates even though my GP and Consultant has written to them with evidence they required for the tribunal! I am going to be making the complaint and also take the case for Gross maladministration on the part of the DWP - they will not get away with this - this time. If anything they have caused me further relapse. Thank you

I have just sent a letter of my grievance to my local MP and in the process of sending a letter to the Chief Executive of DWP and now await for replies. When i do get this of course i will let you all know.

Without you all and this service i am sure i would not know what to do thank you so much.
