ESA AND CHANGE OF CIRCUMSTANCES was created by shrinathji
Hi ALL,

Any advise or help with the following will be much appreciated in my time of despair!!

My husband recently was moved from IB to WRAG without a medical. Last week i got the wheels into motion to appeal decision as he should be in the Support Group with all his problems.

Unfortunately, on Sunday he suffered a Heart Attack, and had surgery yesterday, i will spare you all of the details. However, today he has been told by the Occupational Therapist that he should refrain from any kind of weight bearing or stress related activities, as this can cause more heart problems!!!

I explained my husbands situation to the Occupational Therapist with regards to his current position with DWP, ESA and the Appeal. She said she will put this in writting that any form of work would be dertremental to his health and that this heart attack will take a long time to recover from, especially as he has pther disabilities.

Can anyone please advise what is the best way forward with DWP, as i have already lodged an appeal!!!!

So sorry this is long, but just cannot get head round.

Many thanks.

Radhika.

Hi R,

I am really sorry to hear of your husband's heart attack.

I would advise that you inform the DWP Decision Maker that you sent your appeal submission to, ASAP, with any written evidence of your husbands recent heart attack.

This way the DM can take these new circumstances into account at reconsideration stage.

It may be prudent to inform them by phone, telling them that written confirmation is to follow ASAP.

Best Wishes, to you and your husband. :)

Thanks. You're a real bro(58).

Have been worried sick.

Will get onto DWP ASAP and will do as your suggestion as it makes sense.

Thanks a million.

Hi R,

You're welcome.

It may help also if you could ask the OT to not only mention that your husband is not fit for any type of work, but neither is he capable of attending any interviews (WFI's)
or getting involved in any Work Related Activity, (WRA).

This may help to gain him LCWRA, (Support Group status)

cheers

Take copies of the occupational therapy letter and send copies recorded delivery to the DWP main office and also your local office. Keep a copy for yourself so you can present it, should it go beyond the reconsideration stage.

Hi,

Thanks a million. It really helps to liase with people who not only have a clear head, (presently mine is all over the place) but also your best interest at heart. By the way what is LCWRA???

I will certainly inform OT of the above and will keep you informed.

Radhika.
