I have had the phone call from the job centre to tell me that i will not be awarded esa, i think she said i had got 6 points from medical. My medical was over 3 months ago and lasted about 15 mins, mainly computer generated questions, apart from asking about medication nothing else to connect to me or to my esa50.The women at jc said i will be receiving some information in the post soon and my Ib will be stopping soon. I am now in a bit of an emotional state, confused and bewilded.I have Me/Cfs and some mental health problems,I have been on Ib for over 10 years.I have no choice but to appeal and aranged to see my Doctor tomorrow for a chat. The Esa system is so unfair, I find form filling and paperwork difficult and like everybody else wish i could get better.

Mike

You must be extremely upset, and quite shocked having been on IB for over ten years. I think it is outrageous that you have been kept waiting for the result for so long.

Try to be positive - it is happening to lots of people who go on to win their appeal and it sounds like you have a supportive GP.

You just need to establish a clear picture of which criteria you feel apply to you and follow the guidance on here.

Best wishes

Thankyou for your reply catherine,i have seen the doctor today who said when i get the paperwork from Dwp to go and see him and he will give me a sick note. I asked the doctor if Dwp or Atos had contacted him and he said they had never contacted him about me or any anybody else (suprise, suprise).

A question to the mods,i think i need to ask the Dwp for a Es85,Es85a,could you please clarify if this is correct, thanks.

Michael.

Hi Mike, sorry to hear about your dilemma. You're not alone...many people are in the same boat. It's also an issue with certain conditions that there is still some stigma attached to them and if you look OK and have invisible illnesses. I have ME, so can empathise. Appealing is your best bet and get your doc on your side. This site is great to find out how to appeal and raise your chances of getting a fair response. So many people are either not getting into ESA or if they get into support, the majority get into WRAG, which is disgusting.

Hi M,

As you had a face to face assessment, it would be an ESA85, there may also be an ESA85S add-on to the computer generated ESA85 and there could also be an ESA65, "written statement of reasons".

See info on ESA Forms here :

www.benefitsandwork.co.uk/forum?func=vie...mit=6&start=18#72594

If you are going to appeal you have 1 month from the date of the decision that will be on the letter when you receive it.

Do this on form GL24 which can be downloaded from this FAQ :

www.benefitsandwork.co.uk/forum?func=vie...id=10&id=70444#70446

You must also gain a Med Cert (sick note/fit note) off your G.P. whilst appealing, it would be advisable to make sure this Med Cert covers you from the date of non award of ESA, to ensure there is no break in your payment of benefit.

It may also be prudent to submit your appeal ASAP after receiving written confirmation of the decision, to avoid the same.

Have a look at the FAQ's on appealing from here :

www.benefitsandwork.co.uk/forum?func=vie...id=10&id=70444#70444

cheers
