By ek it gets nearly impossible after April to get anything CB based, even if you were terminal! Mad

Hi B,

There are no particular support group descriptors for any particular medical conditions.

It is the resulting limitations caused by the conditions that must fullfil the SG descriptors.

Hi
I am confused concerning CB ESA with regard to my own case.
I have appealed WRAG to be placed in the support group, am at the mo getting CB ESA WRAG,previously IB migration, my question is... is it worth appealing as I have been told by DM at DWP today that my appeal will be at least 6 months just for a reconsideration as the appeal volume is so much! ... longer if a tribunal, this will take me past April 2012, although my migtation was oct 2011, so if I am entitled to support group I won't get any money past april 2012 anyway..or would it carry on to october 2012 if I was in the support group? Would I have to be in the support group after appeal before April 2012 to not have my CB ESA stopped?

Hi B,

The reconsideration will be done automatically as you have appealed, if the decision is not changed at this stage , your appeal will be sent forward to the Appeals Tribunal Service.

The DWP generally state around 12 weeks for a reconsideration process, however recently we have seen this process being completed much quicker than this.

Please take into account that if you are given SG status at the reconsideration stage, or at the Tribunal Hearing, if it goes that far, that the SG award will be backdated to the date of the original WRAG award that you are appealing.

Therefore, if this was the case, the time elapsed since the original WRAG award would not count off your 365 day entitlement, as you would then be classed as having SG status for that period.

Hi B,

I missed your other question. :)

If you were awarded Contributory ESA WRAG in October 2011, and nothing changed then you would continue to receive the same until October 2012.

If a claimant was in receipt of Contributory ESA WRAG from April 2011, as soon as the new legislation came into force in April 2012 their Contributory ESA would cease, as they will have already had their 365 day entitlement, and the legislation is being applied retrospectively.
