migrating from IS to ESA & med 3 rule ? was created by twinkerzzz
Hi
I understand that it is usual to submit a fit note / med 3 / statement of fitness for work when applying for a NEW esa claim....
BUT
if your current income support claim is being MIGRATED onto ESA, do i need to submit a med 3 to support my ESA50? www.benefitsandwork.co.uk/components/com...emoticons/exclam.gif

The doctor was willing to, but stopped short because he was concerned doing so might screw up in relation to my current Income |support and DLA levels.
Is this so when MIGRATING benefits in this way?

Is it better NOT to submit a med 3 ?
Are med 3s only valid for 3 months ?
How long can a Doctor state the med 3 is valid for ?

Could someone please provide a little knowledge regarding the submission of Med 3s in relation to this situation where the current benefit is being migrated and i expect to stay on esa for longer than 3 months.

No, you don't.

The transfer is considered to be part of your existing claim.

The Fit Note can be written for longer than three months, once the patient has been subject to a Fit Note for more than six months.

Hi n,

You do not have to provide a Med Cert/Fit Note with your ESA50 if being migrated to ESA. As long as you did not normally have to provide Fit Notes while in receipt of your IS.

In other words if you weren't providing Fit Notes before migration then you do not have to on migration to ESA.

If this is the case, then the only scenario where you may have to provide a fit note in the future, is if you are found "fit for work" as a result of your ESA WCA migration process, and you wish to appeal the decision.

If you are currently receiving IS on the grounds of disability and are being migrated to ESA, there is no need to submit a further medical statement (form Med 3)

Form Med 3 can be for a period exceeding three months, once a patient has been receiving this form for more than six months.
