ESA - Partner's Income Support was created by Patel

I am completing my ESA50 form to transfer
from IS to ESA on medical grounds. My IS
claim includes my partners IS as well as she is my carer. ESA 50 does not mention
partner or partners details.I claim IS for her as my carer. What happens to her claim!. What rate will she be paid at.
Also i read somewhere that the amount you
will get cannot be lower than what you get now on joint IS.Is that true. My partner is perfectly normal.

As you are receiving IS because of Incapacity you will be tranferred to Income Related ESA and under the Transitional Protection should receive the same payments as now. Your partners Carers Allowance is paid as a result of your DLA and will not be affected.

As an alternative to transferring to ESA, you should be able to move your current IS to a standard IS claim due to your partner being your carer.

You need to speak to your local CAB or Welfare Rights office in order to understand which would be best for you, as they willl be able to detail your obligations under ESA versus the income you would receive under each of the two options.

Sorry my parther doesnt receive DLA at
all.I receive joint IS with her but she does not work as she cares for me. My
IS is as a joint claim.

Income Related ESA is paid as a couple in the same way as IS is, so there should be no change.

The Transitional Protection will mean that you should not receive less than you currently do if successfully transferred.

If the ESA payments are less than you currently receive, then you will receive an additional amount each week to make the amount up, this will reduce each year as the ESA rates are increased, until the ESA rate catches up.

If the ESA is more than you currently get, then you will be moved to the ESA rate immediately.
