Form completion time was created by pickles
As I understand it you now have 4 weeks to complete the ESA50 form. But what if you are sent the form late and have less than 4 weeks to fill it out, can you do anything about it?

Please can anyone also advise me if you can send a printed version of the form or must the original form be completed by hand.

Thanks

Hi P,

The 4 weeks is actual legislation, see this extract :

Amendments to the Social Security (Incapacity for Work) (General) Regulations 1995

9.—(1) The Social Security (Incapacity for Work) (General) Regulations 1995 are amended as follows.
(2) In regulation 7(2)(18) (failure to provide information)—
(a)in sub-paragraph (a) for “6 weeks” substitute “4 weeks”; and.
(b)in sub-paragraph (b)–.
(i)for “4 weeks” substitute “3 weeks”, and.
(ii)for “2 weeks have” substitute “1 week has”.

Just to add to the points raised by BRO58, above.

The legislation does not allow for the extension of the completion period, so even if offered by the DWP, you should aim to return the form by the original, unless, the extension is confirmed in writing.

We would not advise any claimant to do so, but it is possible to return the form late, providing you are able to show Good Cause for the late return. Examples of Good cause are; whether you were in the UK at the time, your health at the time, and the nature of your disability.
