ESA113 - when requested by DWP?

Can anyone clarify if there are specific circumstances that an ESA113 is sent to the GP for completion please?

I am guessing that they are not routinely sent to the GP for starters? (ie with each ESA application otherwise the GPs would be up in arms :ohmy: )

So I am wondering then are they routinely sent if someone puts in an appeal - and if so do they do it at the reconsideration stage, or at the appeal stage, or not necessarily at all?

The notes on the guidance to GPs on filling them in, indicate that they are just sent to GPs if the DWP want to check if the patient has a severe health condition or disability. So does this mean that in fact they ONLY send them if they suspect the person may qualify for the Support Group?

The reason I am asking is that if you have a not very helpful GP who will not supply medical evidence, I was wondering what the chances were of the DWP seeking out info themselves?

Hi M,

It would seem that an ESA113 is not sent to a G.P. on every occasion.

It could be sent to substantiate a claimant's claimed medical conditions, and their resulting level of limitations, or purely to provide the DM with more evidence to enable him to come to a decision.

If a DM gave an adverse decision, without issuing an ESA113, in the scenario that you mention, it could be asked, why this had not been done.

Especially if the claimant requested that the DWP/ATOS contacted their G.P. for further evidence in their ESA50.

As you may know, even though a person's G.P. is not contractually obliged to provide letters of support etc for them, they are obliged to provide information to the DWP, on any such request, as in the ESA113.
