DLA-Payment pending appeal outcome???

Hi-I have looked at DLA resource info but not find answer to my question-can you point me in the right direction please.If i am turned down on renewal application am i right to assume benefit is not paid pending outcome of appeal??

Hi M,

Yes you are correct.

If a DLA award is lost on review, then the DLA payment will cease, until either the adverse decision is changed at reconsideration stage, or if not then, at the time of the Tribunal Hearing's decision.

This is for obvious reasons, as if the payment was continued whilst appealing, and then the adverse decision was not overturned, it would result in an overpayment, which would then have to be "clawed back"

I should have also added, that if an adverse decision is changed in a claimant's favour, that any DLA payments owed to the claimant will be backdated to the time of the original adverse decision that was appealed.
