re. ESA - Should GP report say UNABLE to work?

Hi there,

I am currently doing ESA Form 50, and have asked my GP to do a letter/medical report to attach, to support my case.

I have ME/CFS and have no other consultant/medical treatment.

My GP has agreed to do this and will write about my symptoms and how they effect me which I hope will be very helpful.

My question is it appropriate for her to write directly whether in her opinion I AM FIT TO WORK OR NOT? She does not think I am I know. But should she specifically write this opinion in her report? Would it help my case? OR should she just stick to medical symptoms and my daily life?

Much appreciated if you can manage a reply on this.

You don't say whether this is a new claim or whether you are being transferred from an existing benefit to ESA>

If a new claim, then your GP, will already be providing Fit Notes, stating you are unable to work, so there is no reason why they shouldn't state so on any report they produce.

In either case, you should remember that the Decision Maker is only interested in your ability to meet the ESA descriptors, so a report that specifically refers to these, will have more relevance than one that talks about you working in a generic manner.

Thank you for your reply. I am one of the people being transferred from IB to ESA - have been on IB for 4 years and had a medical 3 years ago.

I am on higher rate mobilitiy/lower rate care allowance (reduced from middle earlier this year).

I am not sure I understand what you mean by "generic"? I mean should my GP express an opinion as to why I should NOT work and the NEGATIVE effect that would have on me? Do you mean she should express an opinion about what type of work I am not able to do (all types, since my mental fatigue is too debilitating)?

When she did DLA letter it was just about my life and symptoms in general, with no reference as to whether I could work or not. Should I add this to the ESA report?

The DWP and ATOS are very could a drawing conclusions from simple and often innocent statements.

Sometimes having no GP report can be better than having one, if that report does not appear to fully support the claimant.

Apologies if I am not making myself clear. My GP IS going to do a supportive statement for me!

I was just wondering if she should ALSO express her opinion that working is not a realistic option for me in her statement.
