I applied and was turned down for disability living allowance in october 2010. I requested that they look at it again but again I was turned down in March 2011. It was then that I took it to appeal and was told that I wouldnt hear anything about a tribunal until after July 2011, I heard nothing from them so I rang them up in October 2011 to find out when I would hear anything about a tribunal and was told that it would be at least another 3 months. I received a letter from the DWP in December 2011 informing me that they were again requesting a further doctors report so i called the DWP again to ask why and was told that my appeal was being looked at again before going to tribunal. I told them that I was confused as to why they were doing this as my claim had already been re-assessed once and I was awaiting a tribunal hearing but was again told that this is the normal way things are done. I went to my doctors who had already provided supporting evidence on several occasions about my health and the problems I have and asked that this time if she received a request from the DWP about my DLA claim that she does a complete report backing up her letter instead of just answering the questions with short answers. She said she would do this but couldnt see why she needed to do it again or why. Is this the norm or not does anyone know. On the 19th January I will have been trying to get DLA for 15 months and if the 68 week timescale is correct I still have at least another month before I hear anything

In some regions, but not all, the DWP are re-assessing appeal claims, just before the hearing to see whether they would now find in favour of the claimant.
They are not normally as pro-active as to request additional evidence, in fact this is the first time I have heard of them doing so, normally they simply review the evidence that has been submitted to the Tribunal.
If they still do not Revise the Decision, then you will continue to an Tribunal hearing.

Mine was just after your claim and my tribunal is in the next days and I have to say I have had nothing like what you are experiencing

I got a copy of the form doctor filled in for DWP, and I am totally fed up after reading it, she failed to put in all my medication, she got info wrong saying I had only started using a stick in June last year when in fact this is when she came back off sick herself, I began using it in 2010, and from what she put " her problems show significant disparity to her reported difficulties. I feel that there is substantial psychological overlay" I feel that she is calling me a liar and a hypochondriac. I am going to see her this afternoon to find out exactly what she means by it. I think its because I went online and found out that the chest pains and palpitations I was having was probably another symptom of Fibromyalgia, called costochondritis, this was after having tests done for heart problems came back as normal. You cant win but was thinking about asking to see my medical records and also about changing doctors because my doctors seem to be fed up with me, needless to say the DWP did not change their original decision so am still waiting to go to tribunal and have been told that by DWP that in Derbyshire there is a 54 week waiting time from them receiving the appeal form to going to tribunal so am probably looking at having an appeal tribunal back end of March
