Please confirm the following assumption: whether in the Support Group or the work related group = any benefits will only be paid for 12 months if you fall into the group of people whose savings are above 16k. Many thanks.

As it developed into the 365 day limit discussion.

As it stands any time spent in the SG will not count towards the 365 day limit on Con ESA, however the way it looks at the moment, once a claimant has exhausted the 365 day entitlement to Con ESA WRAG, they would not be entitled to any more Con ESA even if they gain SG status, unless they can pass the means test for IR ESA.

Thanks- it confirms my view. But it also means that if somebody got 20k savings, spends 18k on a car, would then qualify for ESA ....

It would depend W.

Claimants can not deliberately deprive themselves of capital, say by doing what you suggest, so that they may qualify for a means tested benefit.

The DWP would make that decision, and may still deem the claimant to have the 18K, or a percentage of it.

It is not a straightforward situation with a definitive answer.

Would these same rules apply to someone who has been on Incapacity Benefit for more than 2 years but who isn't moved onto ESA because their State Pension Age is before 6th April 2014?

Hi SOI,

There is no time limit on entitlement, for IB recipients, so anyone who stays on IB due to them reaching SPA before the 6/4/14, will not be affected.

The clock only starts ticking once someone is migrated over, or starts to receive Con ESA. (Not Support Group)
