Confused by DWP letter was created by pussycat1961
Hi,
I got a letter today, very confusing. Im on appeal, since last June, so am on the assessment rate. I have just been told that
'We have decided that you have potential for work related activity and you must take part in work focused interviews to continue to receive ESA allowance in full'

I have just been told that the assessment rate is the full rate whilst on appeal, then the person told me this is the WRAG rate.
I have never been asked to attend an interview so am not sure what's going on, and I thought the assessment rate was different from the full rate as your are not in any group. This has not been mentioned in previous letters from them so could someone shed some light please.

Many thanks,
Anne

PS. Surely they don't know if I have potential for work related activity until the ruling from the tribunal.

I should have stated, I was in the WRAG with limited capability before, so am appealing the fit for work decision to go back into that group, not the support group.

Hi PC1961,

As it seems that you are appealing a "fit for work" decision, you should not have to attend WFI's. See here :

Do I have to attend WFIs while I appeal?

The Assessment rate of ESA does not include the WRA Component, and cannot do, as you are not in the WRAG, see current rates and components of ESA.

www.benefitsandwork.co.uk/forum?func=view&catid=13&id=39796

As you are not in the WRAG of ESA, and not in receipt of the WRA Component, then you do not have to abide by the WRAG rules, i.e. attendance of WFI, WRA.

Hi Bro,
Yes, I did point that out to them but they still said I have to attend or lose my assessment allowance, so waiting to hear about a WFI now, if I do, then will take it from there. I will however write to them if I do hear from them again, and point this out in writing before agreeing to a WFI.

Thanks,
Anne

Hi PC1961,

Therefore you can pose the question, why do you have to comply with the conditions of receipt of the WRA Component, and being in the WRAG of ESA, when you are not in the WRAG of ESA, and are therefore not in receipt of the WRA Component?
