Just been going through the "papers" again relating to my husband's DLA Claim, Tribunal on Friday. In 2006 we put in a claim for the care component and marked on the "Help for getting around" section no change as he has been getting the higher rate since 1993 (originaly awarded for life - but wording has now changed to indefinitely) On the papers it states that the Mobility claim was awarded in 2006 - no mention of 1993.It states that "the decision maker has decided that the original decision of 2006 was made in ignorance of or based on a mistake as to a material fact". My point is that in that claim form there were no facts to decide as we did not complete that section as advised by DWP staff. He was getting middle rate care from 2006 that has been reduced to lower and the mobility allowance was cancelled completely since June 2011. Does my husband query this on Friday or is it part of the system that because the claim was looked at again both sections are then dated from 2006 - it just seems that there is no relevance to the length of time he has been disabled.
If you can understand my wanderings any comments would be gratefully received

Yes, you are correct in thinking that DLA Care and Mobility are always awarded as a pair, so even though the Mobility was not reviewed in 2006, there was still a Decision made to continue the claim.

On Friday 20th Jan 2012 my husband and I along with our welfare rights rep arrived for the tribunal sat waiting 1 1/2 hours then the young clerk came out and said that as the panel were running late would we agree to an adjournment, felt like crying but our rep thought it best to agree, so once again we await the system to get back to us. In the meantime blue badge has run out so husband has had to apply by completing yet another form, not now (or yet) being automatically eligible.
just thought would let you know where we are up to. nearly past caring...............
