DLA Tribunal - Result -Turned Down!!

DLA Tribunal - Result -Turned Down!! was created by Angela R
Went through the Tribunal on Monday and the dreaded letter arrived yesterday. I was on HRM & MC & renewal of both turned down. No award made. I am still shell-shocked. Sent in 3 consultants letter and supporting letter from GP, but they made no difference. I was totally honest and even told them I could no longer work. Maybe I should have been more convincing, but the whole thing was very stressful. I only remembered what I could have said after it was over. Is there any further recourse? I really don't have the energy for it.

Hi A R,

You could appeal to the Upper Tier, but this can only be done if an Error of Law has taken place.

What is an Error of Law?

It would be advisable to obtain professional advice if you were considering this.

Where to get advice?

You should request a Statement of Reasons :

Tribunals – Requesting a Statement of Reasons

A request can be made for a decision to be "Set Aside" if there has been some form of procedural error, again though you would need professional advice on this.

A other alternative would be to simply make a fresh claim, as there is nothing to stop you, using our DLA Guides, see :

Exactly why all this sticks in the back of one's throat!! How can you suddenly and without warning be expected to be treated in this way? Give idiots power and this is what comes of it ...

Thanks for your advice. For the moment I won't take it further. I think I'll wait and make a new claim. Do they refer the the tribunal notes and files when making a new application?
