Hi
I am very new to this so will be grateful if anyone can help. I am currently receiving DLA high mobility and low care, however my health problems have slightly changed, although asthma is severe and unfortunately not controlled very well i now suffer with incontinence, I was wondering if anybody out there is getting high care for asthma, as I find I am needing more care. Thank you :cheer:

To qualify for Higher Rate Care you will need to show that you have care needs both day AND night.

Hi Gordon

That was quick, I have briefly and I must say I am overwelmed by it all,I asked for my claim to be looked a while ago and the result was that my DLAremained the same, however, things have go worse my health has deteriated quite a bit.I need quite a bit more help during the night know and was just wondering if I should ask for my claim to be looked at again.

Why can’t you answer a question about my specific claim?

The test for Medium Rate Care is that you require assistance day OR night.

I can only suggest you review the DLA guides to see whether you meet the criteria or not.

You need to be aware that there is a risk associated with asking for a re-assessment.

Is there any risk to challenging a decision?

Hi

the last time I asked for a review of my claim would have been a 12month ago approx, so if i made a claim it would be a new one, but would the dla that i have now be in jepordy (does that make sense) :unsure:

Hi M50,

If you are currently in receipt of an award of DLA, which it appears that you are, and you feel that your Care Needs have increased due to new conditions, or a deterioration in your existing conditions, and you wish to have your current DLA award looked at again, reviewed, because of this, then there is some risk involved in that your whole DLA award will be looked at again.

This could result in a loss or reduction in one or more of your awards, they could stay the same, or you may gain the increase that you feel that you now qualify for.

Please remember, it is not the medical conditions themselves that qualify someone for an award of DLA, moreover it is the resulting limitations/disabilities/care needs that would qualify a claimant for a DLA award.
