State Pension Age counts for IB but not ESA?

Has anyone from the government ever commented on why someone on Incapacity Benefit will not have to undergo any medicals,means testing,etc. if their State Pension Age is before 6th April 2014,yet someone of the same age in the contribution-based WRAG can be called in for medicals up to three months before they retire and subjected to means testing, etc? I am 63 and my SPA is before 6th April 2014, but I have to go for an ATOS "assessment" next week, even though I am going into hospital 8 days after for surgery to sort out a botched metal plate job in my shoulder. Has this injustice ever been addressed? If not, who should I complain to? Surely the same rules should apply for everyone of the same age.

The DWP produced an impact assessment (2010)prior to the IB to ESA tranfer starting, I don't remember this point being raised.
