Hi I'm fairly new so bear with me ..I have looked elsewhere but could not find the answer. I understand you do not deal directly with industrial injuries benefit but wondered if you can you tell me if the appeal procedure is the same or as near as for DLA / ESA.

Hi tn,

As far as I am aware, the benefits appeals procedures are similar.

One difference, that I am aware of is the actual number of panel members that sit on the Tribunal, a DLA Tribunal has three members.

I think the general procedure is similar but there are rules and regulations specific to II.

For example medical examinations may take place at the tribunal, which is not allowed in ESA tribunals.

Hi,

Just to let you know that someone i know appealed against their industrial injuries benefit decision a few years ago, said that on the panel there was a doctor, a lawyer and the third person was someone from DWP???(He thinks)
During his appeal he was asked a number of questions. He said he felt at ease and also had a short medical examination.
He got the decision by post which was in his favour.
However, i must point out that this was a few years ago and am not sure if things have changed!!!
However, i hope this helps.
