Can and should I appeal? And how do I go about it was created by sam
Hi,
I was wondering if anyone can give me any advice.
I was sent a letter on the 28th Jan2012 from Dwp, saying that I get so much (Basic rate) and so much for(IB) age addition too.
Then a few days later I got a 5 page letter saying I've now been put on ESA Contributions based , and I'm in a support group.
And because I'm in the support group, I don't have to attend interviews, but I can volunteer to go if I want too, and this money will be paid from Feb until April 2012 (I'm not sure why for only 2months?
The letter says I can make an appeal,but have to do so within one month of getting the letter.
I was wondering, can I lodge an appeal to stay on IB at all? Or is this there finale decision , and is the appeal thing for people who have not been put in support group, and want to appeal to get in the support group?
I'm not sure what I'm best doing?

All IB claimants are currently being migrated to ESA, so no, you cannot appeal to be left on IB
Normally most benefit Decisions can be appealed but not in this case.

Just to add that the reason your letter refers to April 2012, is because this is when the annual benefit increases are made, ESA is payable as long as you continue to meet the eligibility criteria, just as IB was.
