Do they never leave you alone?? was created by lochlisa
I don't believe it !
ONE WEEK after winning ESA appeal in pop the dreaded ATOS envelope this morning with a nice shiny new ESA50 to fill in and return !
I am staggered by this and now I have to fight again after fighting for a whole year and only recently winning a placement in support.
Do I really have to fill this in or is it possible things have crossed in the post and when DWP update their systems with my Support status I won't need to fill in a new form or am I dreaming?
Totally stressed by all this having just come down after last weeks victory !

I'm really sorry, but yes you do need to complete this new ESA50.
You need to remember that your recent Tribunal was looking at your condition as it was a year ago, the panel could not consider your health as it is now, so in reality you have not been re-asssessed for a year, which is probably why you have received the new form now.
Be sure to review the ESA Claim guides as the ESA descriptors were updated in April 2011.

As things are worse than a year ago should I send a copy of the Tribunal decision with the ESA50 or is that a waste of a photocopy?

There's no harm doing so, the DM may not see it without actively looking for it.thank you Gordon

But remember, it refers to your condition from a year ago, so for it to have weight you need to support it with current evidence that shows that your condition has remained the same or worsened.

Hi LL,
Sorry to hear that you are being re-assessed so soon after your appeal success.
You may wish to consider using the Pdf ESA50 this time, as you will then have a ready made copy which you can use for future reference in any further re-assessments.
