Help needed

From what I can gather from reading your posts, the DLA Unit must have received the original notice of appeal (form GL24) together with the other paperwork because why would an EMP medical examination have been arranged, particularly when the duplicate notice of appeal wasn't sent until December 2011?

Following the receipt of the EMP report, which incidentally although it is preferable the claimant's name and NI number does not have to be entered on every page, was a notification received confirming that the original DLA disallowance decision would remain unchanged, and if so, would proceed to an appeal hearing?

If this is the course of events, a letter should have been received from the DLA Unit explaining that the case would be referred to the Tribunals Service. If not, it would be certainly worth contacting the DLA Unit to confirm what is happening with the appeal?

If notification has been received from the DLA Unit as detailed above, the Tribunals Service should be in touch by way of the issue of a preliminary enquiry form (TAS 1), in due course.

I should have said i have an appael date the end march but was hoping they had comitted some sort of huge error that would make things easier

Unfortunately the DWP have not changed their decision, hence the appeal hearing at the end of March.

Good luck with the impending DLA appeal.
