Hi, sadly my dad is very ill and does not have very long to live :( , I know my dad has left me some money and a share of his small terraced house he has but iam not sure if i would be allowed to keep any of it. I am in receipt of contribution based ESA and DLA, also a small personal pension and child tax credit, this is the only income i have coming in and i am worried that the amount my dad leaves me will be taken in to account and i will have to live off this until it is gone. My dad wanted to leave me the money to pay off some of my morgage to help pay off my house. Could i pay it off my house as the DWP pay or would pay the interest on the morgage if the interest raised above the government capped level, this would also help the DWP as they would no longer have to pay the interest if I paid a good lump sum off it. Thank you

I am sorry to hear about your father, it must be a very difficult time for you.

Your Contributary ESA is not means-tested (even though you possibly lose some of it because of your pension), so it should not be affected, nor will your DLA.

If you are in the WRAG and subject to the time limitation of your (C)ESA your inheritance might then prevent you from getting Income Related ESA, depending on the actual amount and what other savings/income you have.

I only got a decision this wk and it didnt say time limited, just wrag group but only allowed to do limited capacity for work. would they tell me off if i paid it off my morgage or would i have to live on it until its gone etc, very confused and stressed with dad and the possibility of the money my dad wanted me to have and pay off part of morgage will be waisted x

You will get one year on WRAG before you are means tested. I suggest that, in that time, you get expert advice with reference to 'deprivation of capital'.

Whilst Mrs Hurtyback is correct with regard to your ESA(CB) not being means tested, I would recommend you seek face to face advice from a suitable advisor before using your inheritance.

Whilst there is no clear definition of what would be considered "deprivation of capital" it is is possible, with the knowledge that your ESA(CB) is time limited, that a Decision Maker may decide that any significant reduction in your capital has been done to allow you to qualify for ESA(IR).

I do want to stress that the matter is not clear and it is perfectly possible that such expenditure may be ignored, but I think it wise for you to find out.
