esa - change of health issue before 365 days

hi folks, just received latter informing my esa terminates in may this year, i was placed in wrg but informaed i did not need to attend just phone in every now and then to keep them informed.
i have CFS/polio/hypogonadism/fatty liver(non Alchol related), i am next month going to have a major operation on right leg .calf extension and ankle investigation this will keep me off my feet for at least 12 weeks then intensive special physio related to the CFS/hypogonadism, then i will have to have a jones transfer on the other foot same again long period of recovery. do i reclaim esa? or will i need to submit change of details..surely one could not be in a work related group with a split cast on? or is this a new claim?
confused.. i am also i'm 54 years old and worked up till last year..so much for NI payments for sick pay..

Hi P,

Although you can not "reclaim" Contributary ESA, once your 365 day entitlement to CESA in the WRAG ends,unless you have acquired the necessary NI Contibutions through work, if you feel that you should now be in the Support Group of ESA, especially with the new developements that you mention, you could ask for a review to be placed in the SG.

There is of course some risk involved, in that your whole claim would be reviewed, and there would be a chance, however small, that you may lose your WRAG award.

As you will see from the information on the links in my previous post, if you can gain entry to the SG, there is no time limit for as long as you remain in the SG.
