Migrated to ESA Sept last year. Placed in WRAG. Since my medical I have now had a right hand operation (lengthy recovery). I am also on waiting list for spinal surgery.

Debating re appeal. But 8 operations in 5 years doesn't look as though I warrant being put into the support group. Yes this would be the answer to my prayers like thousands of others in same situ.

I don't do the phone calls and like everything in writing. Wrote to JCP 24th Jan informing them of 2 pending operations and asking to reconsider their decision again - NO RESPONSE!

Wrote again 27th Feb asking what is happening and enclosed the original letter with supporting evidence. NO RESPONSE!

Recieved a letter telling me the amount of benefit as of 14th April. No change! Same amount that I was on whilst receiving IB.

Looked up on the net and the amount I receive is same as 'support group'. I am in the WRAG - feel like one!

I have sent letters by recorded delivery. Why does JCP not respond? Is it just Newcastle that cannot cope?

If you were transferred from IB to the WRAG in September last year, then you are outside of the normal one month to lodge an appeal to be placed in the Support Group, and this may be why you letters are being ignored.

If your condition has deteriorated since last years Decision, you need to request a SuperSession of your claim, this is effect requesting a re-assessment. You should be able to do this over the phone, by contacting the DWP office dealing with your claim, but I would recommend that you follow it up in writing.

On this notification letter dated 15/3/2012 it says how to appeal, fill in GL24 if I think the decision is wrong. Send within 1 month. So.. should I appeal?

What is the notification letter in regard to, as you said you were transferred last year?

You cannot appeal on the basis of conditions that have worsened or appeared since the Decision was made, you can only ask for a SuperSession as I explained in my previous post.

I think I understand now. The letter that I have received has no code number on. It is probably just informing me of the amount of benefit I will receive from April 9th.

So although I have informed JCP of future operations, asked for a review etc, should I now write and ask for a supersession as my condition has deteriorated and I am also on the list for further spinal surgery. ATOS have stated that I am unfit for work for at least 2 years and that they don't see my condition improving.

If you believe you now, not will, meet one one or more of the Support Group criteria, then you can request a SuperSession on your claim, this can be done over the telephone, but I would follow it up in writing.
