Fone Call From DWP

Had the standard fone call today from DWP stating i am fit for work, which proves that every answer i gave at my ATOS assessment that i was asked the nurse conducting this has entered something different in her computer FARCE.Here comes an appeal.Can anyone advise me if JSA is means tested as i receive 2 pensions each month, neither my wife or i work and we rely solely on these pensions and IB DLA plus CA. Need to start collating information and drafting a letter useing the very good letter templates on this site to ask for all my medical evidence etc.Any assistance will be appreciated.

Just to add to Gordon's good advice.

If you are to appeal, within 1 month of the date of the "fit for work" decision letter, using form GL24, you also have to provide a "fit note"/"sick note" from your G.P. to cover you from the date of disallowance of your ESA.

You can not be compelled to attend WFI's or WRA, whilst appealing a "fit for work" decision.

Thanks,can anyone tell me if i were to lose everything and be found fit for work and placed on JSA does my personal pensions get counted as income and JSA reduced accordingly, neither me or wife works and what would i get paid for me & wife on JSA.

As I understand it, you would not be 'placed' on JSA, it would be up to you to claim if you feel you can fulfill the conditions. Any income would be counted for income-based benefit. I don't know about contributary JSA, however I do know that occupational pensions (yours) can result in a reduction in contributory ESA.

I cannot find anything about this on the government website but Nottinghamshire District Council explain it here .
