DWP totally confused my husband's tribunal!!!!!!!!

Can't believe what has happened, my husband's tribunal for dla is put in jeopardy by the incompetence of dwp. Tribunal date was today 26th of Match. My husband's dla was awarded and did not end until September 11. We completed renewal form and sent in. Dla was stopped in August 11. A medical was carried out by ATOS, again decision still stood even though he had been in receipt of dla h/r mobility and m/r care component for 10 yrs. We sent in extra evidence and and the gp sent a report in January 12. Still the decision stood, he then sent for appeal which was for today.

He received a phone call on 22nd March from dwp saying they owed some back dated money. My husband gets a bit confused due to all medication he takes. Got a letter on Saturday 24th of Match saying that the appeal had been stopped and they were awarding he dla at h/r mobility and m/r care from August 11 - September 11. Deicision was made on gp's letter January 12 and extra evidence we had sent and claim form (renewal).Phoned the representative and he advised that we should not attend hearing as it looks like it had been stopped. Dates for renewal were from August 11 to September 11 (was this a mistake?). Blackpool haven't got a clue what is going on and got phone call from representative today to say we should have gone to hearing!!!!!!. He was going to take us as husban's mobllity not good and have had car taken away and he cannot use public transport. Now tribunal may have made a decision without us being there even though we wanted to be there. Confused and very upset as may go against us for not appearing even though we were adamant we wanted to be there. Stress is causing my husband to be very ill. HELP!

You really can't do anything until you know what happened with your Tribunal Decision.

Did your representative attend?

If the panel made a Decision in your absence, it may be possible to have it overturned based on your not being at the hearing, you will need to discuss this with your representative.

The DWP letter sounds more like there was a an error in terminating the previous award and that your husband should have been paid for an extra month.

An award for DLA cannot be made for less than 12 months, so the dates on the letter do not fit with this at all.

Hi Gordon.

We are just stressed to bits. The representative told me on Saturday that he would pick his copy of the letter up today and go to tribunal court to see if he could have this adjourned so we could try and make head an tail of the letter. However speaking to him today, he has just phoned the tribunal and he did not attend. So angry and upset. Don't know where to go from here!!!!!

I can appreciate how you must feel having waited all this time, only to see it all unravel, however, until you know know what happened ay the Tribunal, there is nothing you can do.

Hopefully, with neither you nor your representative attending, the panel will have adjourned the case until a later date.

Hi some updated information. My husband received the dreaded brown envelope today from the tribunal. Suprised to bits to see they have awarded him with DLA m/r care component and h/r motability which is what we were receiving before. Weight totally lifted off our shoulders and can now destress until 2014 when we have to re-apply :) This sight has helped us a lot and it is great to put your views on here and get advice. Thanks
